Terms of use

These terms apply when you use Klapday, published by Eric Leroy, sole trader trading as Z-AX Agency (see the legal notice). By creating an account you accept them.
Who can use Klapday
You must be at least 16 years old. One person, one account. You are responsible for what is done with your account.
How it works
You film short clips inside closed groups that you create or join by invitation. Members of a group see each other's clips. The app assembles the clips into a film that each member may export and share. Members may answer a clip with a reaction or a short written reply; written replies follow the same content rules as clips and are checked before publication. The owner of a group may remove a member, who then cannot rejoin it without the owner's agreement.
Content rules
The following is forbidden on Klapday, in clips, pictures, names, captions, group descriptions, written replies and shared films:
- any sexual content involving a minor, or any content that sexualises or endangers a child;
- nudity and sexual content;
- violence, threats, harassment, bullying and hate speech;
- content that encourages self-harm or dangerous acts;
- illegal content or activity, including the sale of illegal goods;
- filming or sharing someone without their consent, or sharing private information about them;
- impersonating someone else, and any attempt to get around moderation.
Moderation
Content is checked automatically before it is published. Content that breaks these rules is refused or removed. Depending on how serious it is, we may suspend or close an account. Content involving the sexual exploitation of children is reported to the competent authorities and the account is closed. If your clip is refused and you think this is a mistake, you can ask for a human review from the app.
If we refuse or remove content, or suspend an account, we tell you so in the app, with the reason, unless the law prevents us from doing so. The first check is automatic; you can ask for a review by a person, from the app or at contact@klapday.com.
Reports
You can report a clip, a film or a person, and block a person, from the app. We review every report.
Your content
You keep all rights to what you film. You give us permission to store your content, to check it, and to show it to the members of your groups and to the people who open a link you shared, for as long as needed to provide the service. This permission ends when the content is deleted.
Klapday Premium and paid events
Klapday works without paying. Klapday Premium is optional: it keeps your group's clips online beyond 30 days, removes the watermark from your films, unlocks the monthly recap and allows groups of up to 30 members. It is sold as a weekly, monthly or yearly subscription, or as a one-time purchase that gives Premium for as long as the service exists ("for life"). Before you buy, the purchase screen shows the price, the length of each period and how to cancel.
Subscriptions renew automatically at the end of each period, at the price shown before you buy, until you cancel. You cancel at any time in your Google Play or App Store account settings; Premium then stays active until the end of the period already paid. Deleting the app or your Klapday account does not cancel a subscription.
An event holds up to 10 people. Its organiser can buy a bigger size (25, 50 or 150 people) with a one-time purchase that applies to that event only. A paid event includes its final film without watermark and its clips kept for one year after it ends.
Purchases are made through Google Play or the App Store, under their own payment and refund terms. Where the law gives you a right of withdrawal or a legal guarantee, these terms do not limit it.
Inviting friends
An invited account counts when its owner joins one of your groups through your invitation and publishes a first clip. It counts only if the account was created less than 7 days earlier and had never joined a group. Each account counts once, for one person only.
At 3 accounts counted, you receive 30 days of Premium. At 10 accounts counted in total (the first 3 included), you receive 365 more days of Premium. Each reward is given once per account; the days are added after any Premium period already running. A reward has no cash value and cannot be transferred.
We may refuse or withdraw a reward obtained through fake accounts or any other abuse. We may end or change this programme for the future; rewards already received stay yours.
Sharing outside the app
Before filming or sharing an identifiable person, get their agreement, especially if they are not a member of your group. When you export a film or share it by link, you decide where it goes and you are responsible for it: make sure everyone who appears in it agrees to that sharing. Anyone who appears in a clip without having agreed can ask us to remove it at contact@klapday.com.
Leaving
You can delete your account at any time from the app. We may suspend or close an account that breaks these terms.
Availability and liability
We do our best to keep Klapday working, but the service is provided as it is, without a guarantee of uninterrupted availability. Keep your own copy of the films that matter to you. To the extent the law allows, we are not liable for indirect damages. Nothing in these terms limits the rights that consumer law gives you.
Law
These terms are governed by French law, without depriving you of the protection of the mandatory rules of the country where you live.
